If I test positive more than once am I entitled to NYS (COVID-19) Paid Sick Leave each time I am ordered to quarantine?

On June 252020 the New York State Department of Health and New York State Department of Labor revised the rules on this.  The new rule makes HCP’s eligible to receive NYS (COVID-19) Paid Sick Leave pay of up to 14 days each time he or she tests positive and is ordered to quarantine for a maximum number of three times.

Example: If an employee tests positive and is ordered to quarantine for 14 days, the employer has an obligation to pay the employee NYS (COVID-19) paid sick leave for the duration of the quarantine, up to 14 days.  Let’s say the employee tests positive two weeks after returning to work from the previous quarantine, the employer has an obligation to pay the employee NYS (COVID-19) paid sick leave again for the duration of the quarantine, up to 14 days.  Should the same employee test positive again at a later date and is ordered to quarantine, the employer will have one last obligation to pay the employee NYS (COVID-19) paid sick leave pay.  After the third time receiving NYS (COVID-19) paid sick leave pay, the employer obligation ceases and any time off for quarantine may be paid using the employees earned/accrued paid time off.
